Animal Health and Production Act, 2016 (No. 7 of 2016).

This Act makes provision for measures to protect animal health in the Bahamas. "Animal" means a terrestrial and aquatic animal (including birds and bees) of any kind, domestic and wild and semen, embryos and ova. “Aquatic animal” fish, molluscs crustaceans and amphibians originating from aquaculture facilities or removed from the wild, for farming purposes, for release into the aquatic environment or for human consumption.
The objectives of this Act are- (a) to promote animal health and production through good agricultural practices; (b) to prevent the introduction and spread of animal diseases and alien species; (c) to regulate the trade in animals, animal products and animal-related items; (d) and to give effect to the World Trade Organization Agreement on the Application of Sanitary and Phytosanitary Measures (SPS) Agreement.
There shall be a Director of Veterinary Services appointed under section 12 of the Bahamas Agricultural Health and Food Safety Authority Act, 2016. This Act defines the functions of the Director. An Animal Health Advisory Committee shall be established. The Director shall prepare an animal disease emergency plan and may declare the outbreak of a disease emergency. Veterinary Inspectors may declare infected zones. Upon the recommendation of the Director, the Minister may, by Order, declare a zone to be a disease-free zone, a buffer zone or a surveillance zone.
The Act further provides for, among other things: quarantine and additional disease control measures; duties of animal owners also with respect to care of animals; animal welfare; the setting of minimum standards by the Director for (import of) animal feed; regulation by the Director of the use of veterinary biological products and drugs used for veterinary purpose; import and movement restrictions for animals and animal products; requirements and registration of animal establishments; inspection of imports; export and transit requirements; sanitary requirements for premises; regulation-making powers of the Minister; designation of animal health inspectors and laboratories; offence and penalties.
