Abstract
This Act makes provision for promoting and protecting public health and for the conservation and maintenance of the environment. The Act consists of 32 sections divided into 8 Parts: Preliminary (I); Administration (II); Prohibitions (III); Regulations (IV) Entry on premises (V); Offences and penalties (VII) General provisions and procedure (VII); Miscellaneous (VIII).
Part III defines the responsibility of the Minister in respect of promoting and protecting public health and ensuring conservation and maintenance of the environment, provides for the continuance of the Department of Environmental Health Services and the functions of the Department, and provides for the establishment of the Environmental Health Board. The Board shall advise the Minister on matters relating to environmental health. Part III prohibits various activities that may harm the environment or public health, including but not limited to: pollution with contaminants of pollutants (defined in section 2), carry out specified potentially polluting activities without a certificate of approval issued by the Director of Environmental Health Services, etc. The Director may issue an Order in respect of polluting activities pursuant to section 15. Regulation making powers of the Minister are set out in section 17. Part VII further provides for measures of enforcement in matters of environmental protection or public health.
