Waste Act (2004).

This Act regulates waste and waste management operations. It defines waste and related categories and sets out provisions on waste prevention, classification, collection, transport, recovery, treatment and disposal. It specifies conditions under which waste ceases to be waste and defines by-products. It also regulates categories of waste, including municipal waste, hazardous waste, biodegradable waste, plastic waste and extractive waste.
The Act sets out requirements for waste management activities, including separate collection, reuse, recycling, recovery and disposal, and establishes the waste hierarchy. It regulates the organisation and operation of waste management facilities, including landfills and extractive waste facilities, and provides requirements for their operation, closure and aftercare. It includes provisions on the handling of specific waste streams and on restrictions related to certain products and materials.
The Act establishes obligations of waste holders, producers and other operators. It regulates extended producer responsibility, including obligations related to products of concern and the handling of waste generated from such products. It sets out requirements for permits, registration of waste handlers, monitoring, reporting and record-keeping, and regulates the transboundary movement of waste.
The Act regulates waste management planning and the organisation of waste management by local authorities, including waste collection and transport systems. It establishes requirements for supervision, enforcement and liability, and defines administrative and state supervisory responsibilities in the field of waste management.
