Act establishing a sanctions regime for the enforcement of European Common Fisheries Policy.

This Act contains provisions on the implementation of European Union legislation on the monitoring of compliance with the Common Fisheries Policy. It introduces a system of sanctions, the monitoring of observance and enforcement of the legislation of the European Union relating the common fisheries policy concerns, in particular, commercial fishing in common sea areas and associated catches and fish products. The Ministry of Agriculture and Forestry manages and coordinates supervision of compliance with the Common Fisheries Policy and, in conjunction with the National Agency for Rural Development, maintains a record of violations. As the central supervisory authority, the Centre for Economic Development, Transport and the Environment shall operates in cooperation with the other supervisory authorities mentioned in the Act. Pursuant to this Act, the data collected by the Center for Fisheries Control shall been transferred to the Border Guard. Before the decision to impose sanctions is taken, the National Agency for Rural Development shall give the opportunity the responsible party to answer with respect to the presumed offence. The party has the right to appeal against a decision to the competent administrative court in accordance with the Administrative Procedure Act.
The Act contains 73 sections divided into the following nine Chapters: 1. General provisions; 2. Authorities supervising compliance with the European Common Fisheries Policy and their tasks; 3. Control powers; 4. Obligations of the parties covered by the Act; 5. Computer systems for monitoring; 6. (repealed); 7. Infringements and serious infringements; 8. Point system, other additional penalties and registry of penalties; 9. Other provisions.
