Abstract
This Act makes provision for the protection of the environment in Fiji and in the Excusive Economic Zone of Fiji.
The Act, among other things: defines principles and purposes of environmental protection; establishes the National Environment Council and defines its function and powers; defines functions and powers of the Department responsible for Environment; provides with respect to the internal organization of the Department; provides with respect to environmental plans and reports; provides rules relative to environmental impact assessment and audit; concerns waste management control and pollution prevention; establishes an Environmental Trust Fund; establishes an Environmental Tribunal; and defines offences.
The Council shall, among other things, approve the National State of the Environment Report and the National Environment Strategy and monitor and oversee its implementation.
The Department must have a unit responsible for the waste management and pollution and a Waste and Pollution Control Administrator. There shall be an Environmental Register for the purposes of this Act. Discharge and other pollution permits are issued by the Waste and Pollution Control Administrator in accordance with this Act. The Minister may declare an environmental emergency and make Regulations in respect of such emergency. The Water Supply Act, the Forest Decree, the Fisheries Act and the Sewerage Act are among the Acts listed in Schedule 1 ("Scheduled Acts") for enforcement purposes.
