Abstract
This Code regulates spatial planning, architectural and construction activities in Georgia. It establishes the legal framework for the planning and development of territory, including the hierarchy, preparation, approval and implementation of spatial and urban planning documents, as well as the conditions governing land use for construction purposes. The Code defines principles for territorial development and sets requirements for ensuring the organization of space through planning instruments.
The Code sets out the system of spatial and urban plans, including their categories, content and procedures for their elaboration, adoption and amendment. It regulates zoning, land-use conditions, and functional designation of territories. It further establishes rules for construction activities, including technical requirements for buildings and structures, as well as procedures for obtaining construction permits. Competent authorities at national and local levels are assigned responsibilities in the planning and permitting processes.
The Code provides for supervision and control of construction activities, including inspection mechanisms and compliance monitoring. It establishes liability for violations of planning and construction rules, including administrative measures and sanctions. The Code also contains provisions on public participation in planning processes and access to planning documentation, as well as procedures related to enforcement and dispute resolution in the implementation of spatial planning and construction regulations.
