Abstract
This Regulation prescribes the correct handling of substances that deplete the ozone layer and fluorinated greenhouse gases, handling devices and equipment containing such substances or dependents, and handling of these substances after cessation of use of devices and equipment containing them, checking leakage of these substances, manner for the recovery, recycling, reclamation and destruction of these substances, including various fees, further defining the methods for calculating of all related costs.
This Regulation also implements the rules and practices also contained in the following documents: Regulation (EC) no. 842/2006 of the European Parliament and of the Council of 17 May 2006 on certain fluorinated greenhouse gases (Text with EEA relevance) (OJ L 161, 14. 6. 2006) as last amended by Regulation (EC) no. 1137/2008 of the European Parliament and of the Council of 22 October 2008 on the adaptation of some of the instruments subject to the procedure laid down in Article 251 of the Treaty, Council Decision 1999/468/EC with regard to the regulatory procedure with scrutiny Adaptation to the regulatory procedure with scrutiny - part one (SL L 311, 21. 11. 2008) (hereinafter: Regulation (EC) no. 842/2006); Regulation (EC) no. 1005/2009 of the European Parliament and of the Council of 16 September 2009 on substances that deplete the ozone layer (modification) (Text with EEA relevance) (OJ L 286, 31. 10. 2009) as amended by Commission Regulation (EU) no. 744/2010 of 18 August 2010 amending Regulation (EC) no. 1005/2009 of the European Parliament and of the Council on substances that deplete the ozone layer, with regard to the critical uses of halons (Text with EEA relevance) (OJ L 218, 19. 8. 2010) (hereinafter: Regulation (EC) no. 1005 / 2009); Commission Regulation (EC) no. 1494/2007 of 17 December 2007 on the establishment, in accordance with Regulation (EC) no. 842/2006 of the European Parliament and the Council, the form of labels and additional requirements relating to labeling related products and equipment containing certain fluorinated greenhouse gases (Text with EEA relevance) (OJ L 332, 18. 12. 2007) (hereinafter: Commission Regulation (EC) no. 1494/2007); Commission Regulation (EC) no. 1497/2007 of 18 December 2007 on the establishment, in accordance with Regulation (EC) no. 842/2006 of the European Parliament and the Council, standard leakage checking requirements for stationary fire protection systems containing certain fluorinated greenhouse gases (Text with EEA relevance) (OJ L 333, 19. 12. 2007) (hereinafter: Regulation (EC) no. 1497/2007); Commission Regulation (EC) no. 1516/2007 of 19 December 2007 on the establishment, in accordance with Regulation (EC) no. 842/2006 of the European Parliament and the Council, the standard requirements with regard to checking the leakage of fixed equipment for refrigeration and air conditioning and heat pumps, which contain certain fluorinated greenhouse gases (Text with EEA relevance) (OJ L 335, 20. 12. 2007) (in hereinafter: Regulation (EC) no. 1516/2007).
The Annex is an integral part of this Regulation.
