Abstract
The Regulation contains 48 articles which are divided into 13 Chapters: Definitions (I); Principle and Fundamental of Water Right (II); Pattern of Water Management Regulation (III); Water Management Regulation Coordination (IV); Water and or Water Resources Utilization (V); Conservation (VI); Operation and Maintenance of Hydraulic Structures (VII); Financing (VIII); Supervision (IX); Penal Provision (X); Miscellaneous Provision (XI); Transitory Provision (XII); Final Provision (XIII).
According to article 4, a water management unit is adjudicated based upon river basin. A pattern is established in order to ensure the national application of water management regulation and for the purpose of water and water resources protection. Chapter IV specifies the powers of the Minister responsible for water resources development which are relevant to the determination of the utilization priority plan, the regulation of water use, the regulation of disposal methods, the construction of hydraulic structures, etc. As far as water utilization is concerned, the Regulation draws a distinction between "non licence water and or water resources utilization" (described in article 16), and "water and or water resources utilization by licence" (e.g. agriculture, industry, navigation, floating, etc.). Subsequent articles establish the procedure and conditions for the issuance of said licence. Moreover,the Regulation provides for the conservation of water management areas, which include water, water resources and hydraulic structures.
