Abstract
This Regulation, consisting of 84 articles and implementing several articles of Law on Food no. 18 of 2012, provides for regulating food safety and all related matters. The Regulations defines the following relevant terms: food, including: beverage and raw materials, additives and other materials used in the process of preparing, processing and producing food or beverage; food safety; food chain; food production; food storage; food transportation; food distribution; food trade; fresh food; processed food; food additives; certification; food import; food sanitation; sanitation requirements; food irradiation; genetically engineered food; food contaminant; food packaging; food contact substance; food quality; nutrition; extraordinary food poisoning; food safety risk assessment; food business operator; health care facility; food safety emergency.
According to the Regulation, implementation of food safety is conducted through: food sanitation; control of food additives; control of genetically engineered food products; control of food irradiation; establishment of food packaging standard; issuance of food quality and food safety assurance; import of food; halal product assurance for those required; control of outbreaks and through community participation. Matters related to food sanitation provide for: sanitation requirements, food contaminant requirements and its production and distribution; matters related to control of food additives provide for: classification of food additives, production, importation and distribution of food additives, prohibited materials, standards; concerning control of genetically engineered food products, the Regulation provides for assessment and approval, research; matters related to food irradiation provide for: licensing and control of the use of radioactive substances, waste management and hazard mitigation of radioactive substances, environmental sustainability; the Regulation requires any person producing and trading Food to comply with Food Safety and Food Quality standard, on the basis of Ministerial certification, and following registration of production facilities, registration to fresh food of animal product, fish and plant origin; the Regulation prohibits any person from distributing contaminated food.
Concerning controls, the Regulation identifies various Authorities responsible for each type of control; defines implementation of control and inspection, provides for risk management and assessment. Other matters covered by this Regulation concern: administrative sanctions; outbreak and food safety emergencies; public participation and procedures for addressing food safety problems.
