Abstract
This basic Law, making provision with respect to animal diseases, is divided in six Parts and includes two Schedules.
PART I lays down definitions and interpretations of the Ordinance. It empowers the Minister and the Director of the Veterinary Services to amend the two Schedules.
PART II deals with measures to be taken for preventing diseases. Sections 4, 5 and 6 establish the duty to inform any appointed authority and take steps in respect of affected animals. According to section 7 any Government veterinarian shall give directions to the owner of any affected animal concerning its destruction. Pursuant to section 8 the authority in charge shall give directions to authorize burial, destruction or disposal of anything that may have been exposed to infection or contagion of a disease. The authority in charge may decide to have the animal examined, inoculated, treated or marked (sect. 9). Pursuant to section 10 the Authority may direct cleansing or disinfecting of any place or structure, or objects used in contact with an affected animal. The authority may also prohibit further use of such place or structure, or objects. Under sections 11, 12 and 13 any Government veterinarian appointed by the Director of the Veterinary Services may take measures to ascertain health conditions of animals, to prevent the spread of any disease and to ascertain whether any provision or directive of implementation is being contravened.
PART III prescribes compensation for the destruction of any animal (sects. 16,17).
PART IV empowers the Director of Veterinary Services, by order published in the Official Gazette, to declare any area, village or place infected, indicating the site and limits of the area (sect. 18). Any declaration may be rescinded or varied (sect. 19). Section 20 establishes provisions that apply in relation to any infected area. These provisions may be varied or replaced by the Minister of Agriculture. The Director of Veterinary Services may declare any disease as a communicable disease (sect. 21).
PART V, (section 21) allows the Minister of Agriculture to make rules for carrying out the purposes and provisions of this Ordinance, including matters such as quarantine, destruction or disposal of carcasses, feed, dung, treatment, slaughter, movement, transfer or detainment of animals. These rules may also provide for the issue of licenses in respect of movement and removal of animals, importation and exportation of animals, importation of organisms causing diseases, as well as importation, manufacture or use of vaccines or analogous products. Under section 22b the Minister of Agriculture issue rules concerning veterinary practice, carry out supervision of compliance with provisions, and impose the duty of registration, as well as keeping and control of records.
PART VI empowers specified authorities to stop and detain without warrant any person who is found committing or suspected of committing a contravention of this Ordinance (sect. 25); it also gives specified authorities the power of seizure. In sections 27 and 28 penalties are prescribed in specified cases. Sections 29, 30, 31, 32 deal with legal procedures. At end, two schedules include categories of "animals" (stock, fur animals, poultry, other animals) and a list to define diseases.
