Abstract
The Community, pursuant to Decision 88/540/EEC, has become a Party to the Vienna Convention for the Protection of the Ozone Layer and the Montreal Protocol on Substances that Deplete the Ozone Layer. In compliance with the Community s obligations under such agreements, this Regulation makes rules applicable to the production, importation, exportation, placing on the market, use, recovery, recycling and reclamation and destruction of chlorofluorocarbons, halons and the other substances referred to in article 1 and Annex II that deplete the ozone layer.
The Regulation is composed of the following seven Chapters: (I) Introductory provisions; (II) Phase-out schedule; (III) Trade; (IV) Emission control; (V) Committee, reporting, inspection and penalties; (VI) New substances; (VII) Final provisions. In addition, seven Annexes are attached: (I) Controlled substances covered; (II) New substances; (III) Total quantitative limits on producers and importers placing controlled substances on the market and using them for their own account in the Community; (IV) Groups, Combined Nomenclature 1999 (CN 99) Codes and descriptions for the substances referred to in Annexes I and III; (V) Combined Nomenclature (CN) codes for products containing controlled substances; (VI) Processes in which controlled substances are used as processing agents; (VII) Critical uses of halon.
