Abstract
The Liguria Region regulates wildlife protection and hunting according to methods of rational programming and sustainable utilization of the territory and exploitation of natural resources. It guarantees, in association with the Provinces, the conservation and safeguarding of mammals, birds, their eggs and nests as well as the protection of their natural habitats. The Regional Council shall transmit annually to the competent ministry a report bearing the measures that have been adopted for achieving the above-mentioned purposes.
This Regional Act consists of eight Titles. Title I lays down general provisions. Administrative functions shall be exercised by the Region and the Provinces. In particular, the latter must set up Special Protection Zones along the migration routes of bird species, in implementation of Directives 79/409/EEC, 85/411/EEC and 91/244/EEC. Title II regards wildlife protection and hunting planning. The agricultural and sylvo-pastoral alpine territory, which is characterized by the existence of alpine flora and fauna, constitutes a separate wildlife zone. Thereafter, article 4 lays down particular provisions to be applied exclusively over such zone. Article 9 concerns the environmental improvement and wildlife introduction plans to be drafted and approved by the Provinces. Article 10 makes provision in matter of protection of nests. Title III regulates the arrangement and creation of zones intended for particular destinations, including protection oasis (art. 13), repopulation and capture zones (art. 14), wildlife reproduction public and private centres (art. 15). Title IV provides for the organization of hunting activities. To this end, specific Territorial Hunting Areas and Alpine Districts shall be established as per article 19. Title V defines the species that may be hunted and determines related hunting periods and seasons. Title VI regulates the conditions under which hunting may be practised, covering in particular the hunting permit which is required and the fees to be paid to the Region. Title VII sets forth particular prohibitions, regulates surveillance and lays down related penalties to be applied in case of violation.
