Abstract
The Regional Act is divided into five Parts. Part I lays down general principles. The Friuli-Venezia Giulia Region protects fauna with a view to ensuring the conservation, improvement, knowledge and rational use of wildlife species, in accordance with the regional competences established by articles 4 and 6 of the Regional Special Statute. For the purpose of this Act, the regional territory shall be subject to the legal regime of the Fauna Alpine Zone, in which programmed hunting is managed as per Part II, Sections II to IV of this Act. The Region shall destine a part of the regional agricultural and sylvo-pastoral territory (not less than ten percent) to wildlife protection. The remaining territory shall be intended for hunting. Part II concerns the entities and organisms for hunting management. The competences in matter of wildlife protection and hunting shall be exercised by: (a) hunting reserves, which must be non-profit associations; (b) hunting districts; (c) the Region; (d) the Provinces. The regional territory intended for hunting shall be divided into the different units, to be designated "Hunting Reserves", defined by Annex A to this Act. The Region shall draw up the Regional Plan for Fauna Management in order to ensure the conservation and the management of wildlife as well as the rational hunting management (art. 18). The regional administration may at any time, if it deems it necessary, arrange inspection and checks on hunting reserves and hunting districts and related management (art. 20). Articles 21 to 23 establish the following organisms: (a) the Regional Fauna Institute; (b) the Regional Fauna and Hunting Committee; (c) the Permanent Conference of the Presidents of the Hunting Districts. In addition, article 25 provides for the creation of a disciplinary commission which shall apply the disciplinary sanctions referred to in article 38 in case of violation of the provisions hereby contained or of the prescriptions established by the competent entities and organisms. Part III of the Act regards the regional permit which is compulsory to hunt within the Friuli-Venezia Giulia Region. The permit shall be issued by the regional administration under the conditions specified by article 26, paragraph 3 and upon payment of the regional annual fee referred to in article 27. Part IV of the Act makes provision in matter of subsidies to be granted by the Region for the reintroduction of wildlife species of particular interest. Furthermore, article 25 provides for the creation of the Regional Fund for Environmental Improvement.
