Abstract
Chapter I of this Regional Act lays down the derogation regime provided for in article 9 of Directive 79/409/EEC, whereas Chapter II lays down amendments to certain regional provisions concerning the preservation of nature, hunting, inland fisheries and taxidermy
Article 9 (1) of Directive 79/409/EEC authorizes the Member States to derogate from the protective provisions laid down in articles 5-8 of the same Directive, if there is no other satisfactory solution, (i) in the interests of public health and safety, (ii) in the interests of air safety, (iii) to prevent serious damage to crops, livestock, forests, fisheries and water, and (iv) for the protection of flora and fauna. The Annex hereby attached designates the species that may be harvested, the total allowable catch per day and per person as well as the related allowed season.
As mentioned above, Chapter II of the Act contains particular amendments to a number of Regional Acts. Article 7 amends Regional Act No. 34 of 1981 on nature protection. Article 6 of that Regional Act containing the list of edible parts of fresh species which may be harvested is supplemented. Article 17 on frogs is replaced. Articles 17 bis (on snails) and 17 ter are added. Lastly, articles 25, 26 and 28 are repealed. Article 9 hereto amends article 7 of Regional Act No. 56 of 1989 in matter of hunting, game farming, taxidermy and inland fisheries; article 10 hereto amends articles 4 and 5 of Regional Act No. 14 of 1987 on hunting; article 12 hereto amends article 11 of Regional Act No. 21 of 1993 laying down further provisions on hunting; article 13 hereto amends and supplements articles 2 and 3 of Regional Act No. 24 of 1996 regarding those species that may be harvested and related allowed seasons; article 14 hereto amends and supplements several provisions contained in Regional Act No. 30 of 1999 on hunting management and activities in the Friuli-Venezia Giulia Region; article 15 hereto supplements articles 2, 6 and 9 of Regional Act No. 26 of 2002 as regards taxidermy. Lastly, article 16 of this Act supplements article 4 (1) of Regional Act No. 27 of 2002 concerning the recognition of ornithological associations.
