Abstract
The purpose of this Act is to prevent sanitary risk caused by foods, promote the qualitative improvement of food nutrition, and provide accurate information on foods, thereby contributing to the protection and improvement of public health.
The Act prohibits the sale, collection, manufacturing, import, process, etc. of harmful food, the sale of meat affected by diseases, the sale of chemical synthetics, etc. The Commissioner of the Korea Food and Drug Administration shall formulate a Code of Foods to set criteria and standards for food and food additives, for conatiners and packages, for labels.
The Commissioner of the Korea Food and Drug Administration may designate food sanitation inspections and may order business operators who import, develop or manufacture genetically modified foods, etc. as edible foods to undergo safety evaluation of the relevant food.
The Act further provides for: criteria for facilities engaged in the manufacturing, processing, transportation, sale and preservation of food; powers of the Commissioner of the Korea Food and Drug Administration to determine Hazard Analysis Critical Control Points; licensing of cooks and nutritionists; establishment of the Food Sanitation Deliberation Committee to investigate and deliberate on matters concerning the prevention of food poisoning, maximum residue limits of toxic or harmful substances, food sanitation and standards and criteria of food; establishment of food sanitation organizations such as the Trade Association, the Korea Food Industry Association and the Korea Food Safety information Center; establishment of the Council on Food Poisoning Countermeasures; offences and penalties; etc.
