Abstract
The purpose of this Act is to prevent harm to people’s health and the environment caused by chemicals and to properly control toxic chemicals. "Toxic chemicals" means poisonous substances, substances under observation, restricted substances or prohibited substances, substances requiring preparation for accidents, or other chemicals that are or are feared to be toxic or harmful.
The Act provides for the establishment of the Toxic Chemicals Control Committee which shall formulate a basic plan for the efficient control of toxic chemicals. A person who intends to manufacture or import chemical substances shall be subject to the Minister of Environment's toxicity examination pursuant to Ministerial Ordinance of the Ministry of Environment.
The Act further provides for the safety control of toxic chemicals by reporting to the Minister of Environment on the importation of poisonous substances, by registering poisonous substance businesses, inspecting poisonous substance-handling facilities, etc. There shall also be a control on restricted or prohibited substances which are designated in the text. A permission is required to import these substances and conduct businesses which manufacture , sell, use, store or keep such substances.
In addition, the Act provides for: preparation for, and countermeasures against, chemical accidents; the recording and preservation of documents; penalties; inspection measures; etc.
