Abstract
This Law Provides the principles, regulations and measures for the management, protection, development, utilization and inspection of forests and forestland, promoting tree plantations, regenerating and increasing forest resources, in order to make forest resources rich, increase forest cover, as a source for tourism and for sustainable use in people’s livelihoods, to ensures the protection of soil quality, air quality, water sources, biodiversity, and environmental protection in a green and sustainable manner.
The Law classifies forests into three categories: protection forests; conservation forests (protected areas); and production forests. Each forest category may consist of areas of dense forest, dry dipterocarp forest, regeneration forest, and degraded forest.
In addition, the Law makes provision for the management and use of forests and forest land which includes activities of survey, classification, planning, research, logging and forest product harvesting surveys. It provides for: preservation of protection forests, conservation forests and production forest areas and forest land; preservation of water resources within the forest zone; preservation of trees and non timber forest product species; prevention against pests and tree diseases; prevention against forest fires; restriction of shifting cultivation and illegal logging; forest and forest land development; the harvesting of timber and forestry products; etc.
The Law also defines rights and obligations of users of forest and forest land, including the possession and use, the rights to benefit from, transfer, inherit, customary rights and lease of forest and forest land.
The Law further provides for: prohibited acts; powers and duties of forest management and inspection organizations such as the Ministry of Agriculture and Forestry, the Provincial or Vientiane Capital Agriculture and Forestry Offices, the District or Municipal Agriculture and Forestry Offices, and the village Forestry Units; rules for the carrying out of inspections aimed at ensuring that the operation, management and use of forest and forest land are in accordance with the present Law; settlement of conflicts; measures against violators; etc.
