Government Resolution No. HG938/2018 validating the Regulation on the procedure for crossing the state border with goods, subject to control by the National Agency for Food Safety.

Regulation on the procedure for crossing the state border with goods subject to control by the National Agency for Food Safety has been developed to ensure the process of effective implementation of the principle of single window, increasing the effectiveness of control by the Agency based on risk analysis, as well as for the purpose of regulation and standardization of operations to assess potential and identified risks at the border, especially regarding the procedure for applying state control, optimization of the procedure for crossing the state border by cargo and passengers in motor vehicles. It lists border crossing points authorized for passage of goods. Goods specified in Annex No. 1 are subject to veterinary and sanitary control. Goods and wood packaging material used for their transportation, listed in Annex No. 2 are subject to phytosanitary control. Goods specified in Annex No. 3 are subject to food safety control. Import of goods of animal or non-animal origin into the national territory by natural person is carried out in accordance with Annex No. 5. Import into the country of goods subject to food safety control, shall be carried out on the basis of accompanying documents specified in Annex No. 3, and prior notification through the information system (TRACES) submitted prior to the import or transit operation. During import or transit of goods subject to control by the Agency, inspectors of the Agency at border control posts organized at border crossing points, the following types of control are carried out: (a) control of documents accompanying the relevant consignment of goods; (b) control of the identity of the goods subject to control; and (c) physical control of goods subject to control, with or without selection of samples for research in an accredited laboratory.
