Abstract
The provisions of this Law shall apply to fertilizers with CE marking or to fertilizers without CE marking, if they are made available on the market. This Law shall not be applicable to: (a) animal byproducts and derived products not intended for human consumption; and (b) phytosanitary products. Fertilizer shall be intended substance, mixture, microorganism or any other material applied or intended to be applied to plants or the rhizosphere of plants, or to fungi, or the mycosphere of fungi, or which is intended to constitute the rhizosphere or mycosphere on its own or mixed with other material, in order to provide nutrients to plants or fungi or to improve the nutritional efficiency of plants or fungi. EU fertilizers and national fertilizers that comply with the requirements set out in this Law shall benefit from free circulation and their placement on the market shall not be impeded. Fertilizers of the nation al origin that do not comply with the requirements set out in this Law may be placed on the market only for the purpose of evaluating efficacy and laboratory testing, with the written consent of the competent authority, which shall be issued free of charge and within 3 working days from the date of notification to the authority in question in this regard. The Government may establish rules for the protection of health and safety of humans, animals, plants and the environment which are in accordance with the treaties concluded or to which the Republic of Moldova is a party, regarding the use of fertilizers, provided that the rules in question do not require the modification of EU fertilizers which comply with the requirements set out in this Law and do not influence the conditions for placement of those products on the market. EU fertilizers shall: (a) meet the requirements approved by the competent policy-making authority for the functionally relevant product category; (b) meet the requirements approved by the competent policy-making authority for the relevant component material category or categories; and (c) be labelled in accordance with the labelling requirements established by the competent policy-making authority. Fertilizers of national origin must be: (a) included in the national identification list; (b) packaged and labelled in accordance with the requirements established by the competent policy-making authority; and (c) placed/made available on the market together with the safety data sheets.
