Abstract
This Law regulates the general conditions for the production of fertilizers, the placement of fertilizers on the market, their import and export, use of fertilizers, of biostimulants and improvers of soil properties or soil enhancers, including specific rules regarding various types of fertilizers (classified as organic and non-organic, ammonium nitrate fertilizers with high nitrogen content, organo-mineral fertilizers and microbiological fertilizers), their identification, quality, composition, sampling, packaging, repackaging, labelling or marking, testing, declaration, monitoring, registration and offences and related penalties. For the protection of human health and environment in addition to the conditions determined by this Law, for placing on the market and use of fertilizers, biostimulants and soil enhancers, if they contain hazardous substances, conditions set out in the regulations in the field of chemicals shall be applied. If fertilizers, biostimulants and soil enhancers also contain plant protection products, for their production, placing on the market, import and use, phytopharmacy related rules shall also apply.

If on the basis of scientific and technical knowledge there is a justifiable reason that the composition of fertilizers, biostimulants and soil enhancers or their raw materials, pose a risk to the safety and health of humans, animals and plants or pones risk of interacting with water or air (considered as harmful products or that it can become dangerous), the Minister of agriculture, forestry and water economy will: 1) prohibit temporary or permanently the production and placing on the market of such products; 2) prescribe special conditions under which the such products can be produced and marketed. Fertilizers, biostimulants and soil enhancers or conditioners can be placed on the national market if: 1) provide effective nutritional value and improve soil properties; 2) standardized method sampling is provided; 3) in conditions of practical application do not adversely affect human health, animals, plants and environment. The producer is responsible for the conformity of these products which can be placed on the market if accordance with the provisions of this Law and of regulations that shall be adopted on the basis of the same.
