National Environmental (Air Quality Control) Regulations, Statutory Instrument no. 88 of 2021.

These Regulations, made under provisions of section 34 of the National Environmental Standards and Regulations Enforcement Agency (Establishment) Act, no. 25 of 2007, provide for: improving air quality control, in order to enhance the protection of flora and fauna, human health, and other natural resources; ensuring all the citizens the right to clean air, and to benefit from all the natural resources according to the principles of sustainable development; informing the population about any potential hazard, any significant rise in the level of pollution, and the accidental or deliberate release into the atmosphere of harmful or hazardous substances.
The Regulations establish: the maximum permissible ambient air concentrations for certain pollutants in the air, in order to prevent harmful effects on the environment and human health; the maximum permissible emissions. Matters covered by these Regulations include: emissions from stationary sources and permission to install equipments; accidental discharge of pollutants; maximum air contaminant concentrations; pollution abatement technologies; submission of environmental impact assessment, environmental audit report and environmental management plan for any new project; emissions from mobile sources; control of indoor air pollution in offices, homes and public places; ban on the use of certain pesticides; emissions from other sources and ozone depleting substances; mining operations; renewable energy generating plant business activity; ambient air quality standards; enforcement; offences and penalties.
