Abstract
These Regulations implement the Treaty on Fisheries between Governments of Certain Pacific Island States and the Government of the USA. Regulation 36 of the Principal Regulations is amended by inserting new Regulations under the Heading: "Special Provisions Relating to Licences to Fish for Certain Highly Migratory Species" (Interpretation [36A]; Grant of licences authorizing fishing for highly migratory species of tuna [36B]; Conditions of highly migratory species licences [36c]; Limitation of application of certain regulations to highly migratory species licences [36d]).
Schedule 1 (Form for licence to fish highly migratory species of tuna in the Exclusive Economic Zone of New Zealand) and Schedule 4 (Areas closed to fishing under highly migratory species licence) are amended. The foreign fishing craft shall not be used in the EEZ for (a) any other highly migratory species other than tuna, southern bluefin tuna excluded; (b) fishing by other method as purse seining; (c) at times when a licence is not in force; (d) in contradictions with terms, conditions or any other requirement of these Regulations.
