Abstract
This Act is the Local Government (Water Services) (Repeals and Amendments) Act 2025 and provides amendment on various laws and regulations, in the sector of water services. Amendments to Civil Defence Legislation outlines that “water organisation” has the same meaning as defined in section 4 of the Local Government (Water Services) Act 2025.
Amendments to Commerce Act 1986 relates to different types of regulation under Part 52B for water services, application of different regulations in water services, stormwater services, Treaty settlement obligations, water supply service, water supply and wastewater services, price quality regulation, Commission recommendation and process for its Recommendation, Ministry consideration, water efficiency, and granting exemption.
The part related to Consumer protection in relation to water services outlines the framework for protecting consumers of water services, including its purpose, interpretation, and application. It establishes information disclosure requirements, service quality codes, regulatory guidelines, and compliance mechanisms, including penalties, compensatory orders, and injunctions for breaches. Additionally, it clarifies the Commission’s role, monitoring responsibilities, and limits regarding safety and levy regulation.
Amendments to Income Tax Act 2007 refers to water organisations.
Amendments to Local Government Act 2002 grants the Minister additional powers to assist and intervene in water services. It allows the Minister to appoint a Crown facilitator or Crown commissioners, with specified procedures for their appointment. The Minister is also required to consult before exercising these powers.
Amendments to Receiverships Act 1993 provides for Meaning of water organisation and Watercare.
Amendments to Resource Management Act 1991 outlines the relationship between environmental performance standards, infrastructure design solutions, and planning instruments for wastewater and stormwater management. It allows plans to address effects not covered by environmental performance standards or infrastructure design solutions and clarifies how these solutions interact with other regulatory instruments. Provisions are also included for defining, extending, and updating extant wastewater consents, including ministerial authority in exceptional circumstances.
Amendments to Act previously called Taumata Arowai–the Water Services Regulator Act 2020 refers to operating principles. Amendments to Water Services Act 2021 establishes provisions for source water risk management and the development of National Engineering Design Standards (NEDS) for water services networks. It outlines the process for creating, consulting on, recommending, reviewing, and ensuring compliance with NEDS, as well as preparing and applying national codes of practice. It also covers alternative solutions, infrastructure construction and maintenance, and the issuance of warnings by the Chief Executive, alongside applying relevant environmental performance standards under the Resource Management Act 1991.
