Abstract
This Act makes provision with respect to food safety and hygiene in Seychelles. The Act also prohibits the importation or placing on the market in Seychelles of feed which is considered unsafe to food-producing animals. The Act is composed of 41 sections and is divided into six Parts: Preliminary (I); Administration (II); Food and Feed Safety (III); Importation (IV); Enforcement (V); Miscellaneous (VI).
The Public Health Authority shall be the Competent authority for purposes of this Act. The functions of the Competent Authority shall include advising the Minister on matters related to food safety, food hygiene and food borne diseases, implement and maintain food control system, and adoption of the Codex Alimentarius Commission Standards, Recommendations and Guidelines as elements of its national food control system in order to protect the health of consumers. In carrying out its functions under this Act, the Competent Authority shall apply specified principles of food. The Competent Authority may adopt emergency measures as specified in case of a crisis.
Any person shall not operate as a food business operator without an approval from the Competent Authority and shall not place any manufactured food feed on the market without adequate labelling or identification to facilitate its traceability in successive stages of the distribution. As for measures of enforcement, authorised officers may serve on an owner, occupier or licensee of any food establishment an improvement notice or a prohibition notice. An authorised officer may also serve an emergency closing order issued by the Public Health Commissioner.
