Abstract
This Law lays down the principles and principles to be applied and the responsibilities of the parties to protect employees, the public, the environment and future generations from the possible harmful effects of ionizing radiation during the conduct of activities related to nuclear energy and ionizing radiation, based on the principle of peaceful use, and the powers and responsibilities of the Nuclear Regulatory Authority, which has regulatory control authority over these activities, and the legal responsibility for nuclear damages arising from nuclear accidents. This Law obliges natural or legal persons who will carry out any activity related to nuclear energy and nuclear materials to comply with the international agreements and conventions regarding nuclear security to which Türkiye is a party.
This Law sets out rules for: (I) the authorization and inspection by the Nuclear Regulatory Authority for the activities relating to nuclear energy and ionizing radiation, such as for import, export, transportation and transit of radioactive substances; (II) the management of radioactive waste and spent fuel, with a special emphasis on the prohibition of release of radioactive waste into the environment; (III) the legal responsibility for nuclear damages arising from nuclear accidents and the implementation of the Paris Agreement in cases where there is no provision in this Law, and the procedures and amount of compensation; (IV) the establishment of the Nuclear Damage Assessment Commission to evaluate the applications made by those who suffered nuclear damage for compensation for damage resulting from the nuclear accident; (V) organization and the staff of the Nuclear Regulatory Authority; (VI) the establishment of the NÜTED Nuclear Technical Support Joint Stock Company to provide technical support services to the Nuclear Regulatory Authority, such as all kinds of analysis, consultancy, supervision, review, research, examination, testing, control, training and certification; and (VII) offences and penalties, including administrative fines.
