Abstract
This Law defines the relationship between the State and persons or organizations involved in mineral exploration and removal. Petroleum and natural gas are not covered by this Law (art. 4). All minerals in all locations in Albania are owned by the State (art. 8). It governs all existing mineral licences. Mineral licences may be transferred among organizations (arts. 11 and 12). The Minister responsible for minerals implements the law (art. 15). Other provisions include rights licensed for various stages of exploration and removal, which vary according to six mineral classes (arts. 21 to 87). General obligations are settled for licence holders, relating to selecting of (preference given to Albanian citizens) and training employers work conditions, environmental protection, rehabilitation of land, etc. (arts. 89 to 99). Measures to encourage private investments are discussed in articles 100 and 101. Punishments for mineral activities conducted without a valid licence, and conditions under which the Minister may withdraw a license are specified in articles 105 to 108.
