Abstract
Law 81/2017 aims at the designation, conservation, administration, management, and sustainable use of protected areas and biological and natural resources based on the principle of sustainable development in order to guarantee their environmental, economic, social and cultural benefits to all of the society. Further, the law lays down the institutional framework including both public and private entities and their tasks and responsibilities for the conservation and sustainable management of these areas.
The law is partially approximated with Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora. The law is composed of the following Chapters: General Provisions (I); National System of Protected Areas, their Designation, and Categories (II); Changes in Protected Areas (III); Management of Protected Areas (IV); Management Plans (V); Zoning and Subzoning (VI); Ownership Rights in Protected Areas (VII); Financial Management (VIII); Public Participation, Information, Monitoring and Research (IX); Inspection and Sanctions (X); and Final Provisions (XI).
Regarding governance, the National Agency of Protected Areas is the central state institution responsible for their administration and control, while the inspection functions are carried out jointly by the Forestry Police and the administration of the protected area.
