Abstract
Internal waters of the Azerbaijan Republic and the Azerbaijani Sector of the Caspian Sea (Lake) shall be the national wealth of the people of Azerbaijan, used and protected as the base of the life and activities of people and provide the existence of flora and fauna. This Code shall regulate legal relations concerning the protection and use of water bodies in the Azerbaijan Republic. The Law consists of 4 Sections subdivided into 17 Chapters that contain 105 articles. Section 1 (Chapters 1 and 2)lays down the general provisions. Chapter 1 lays down the general provisions. Chapter 2 determines the types of ownership of water bodies. Section 2 (Chapters 3 and 4) regards management over the use and protection of water bodies. Chapter 3 deals with organization of the management over the use and protection of water bodies. Chapter 4 concerns state regulation in the area of the use and protection of water bodies. Section 3 (Chapters 5-15) deals with the use and protection of water bodies. Chapter 5 regards the use of water bodies and water bodies for common use, which shall open and available for everybody’s use. Chapter 6 establishes rights and obligations of users of water. Chapter 7 regards the use of water bodies as potable and service water and for the purpose of health treatment, resort, recreation and sports. Chapter 8 regards the use of water bodies for agricultural needs. Chapter 9 concerns using water bodies for industrial and hydro energetic purposes. Chapter 10 regards using water bodies for transport needs. Chapter 11 regards using water bodies for fishing and hunting. Chapter 12 determines the use of specially protected water bodies. Chapter 13 determines the use of water bodies for the discharge of waste waters, fire protection and other purposes. Chapter 14 concerns protection of surface and ground water, water conservation zones, pollution control and disaster risk management. Chapter 15 deals with locating, projecting, building, restoration and use of enterprises, devices and other facilities affecting the conditions of waters and the obligation for environmental impact assessment report. Section 4 (Chapters 16 and 17) regards economic regulation of actions concerning the use and protection of water bodies, settlement of disputes and liability for violating the water legislation. Chapter 16 regards economic regulation of actions concerning the use and protection of water bodies. Chapter 17 regards settlement of disputes concerning the use and protection of water bodies and liability for violating the water legislation.
