Abstract
This Act aims to the regulation of the management of waste through a strict control of activities generating and treating waste and harmful substances, in a view of preventing and at least reducing the harmful impact of waste on human health and on the environment. This Act is divided into 6 chapters and 13 additional articles. The following types of waste fall under this Act: domestic and hazardous waste, and waste originating from the manufacturing industry and from constructions. Chapter two determines the liability of persons having a waste producing activity or dealing with it in any way (transport, treatment, etc.). This chapter defines also the parameters of waste disposal sites. Chapter three regulates the treatment of waste. Hazardous waste's treatment must be authorized in accordance with Article 37. According to Chapter four people who generate waste of a certain quantity must keep a register. The Ministry of Environment and Water shall keep also a register of the issued permits and of waste disposal sites. A National Waste Management Program shall be submitted to the Council of Ministers by the Ministry. Other local and special activity programs are foreseen by this Chapter as well. The state shall assist the management of waste providing conditions for an environmental friendly treatment of wastes, the reduction of domestic and industrial wastes and the recycling of reusable components of wastes. Chapter Five provides rules for the issuance of permits and the control of waste producing activities. Import, export and transit of waste are subject to permission by the Ministry as well. Authorities which perform the control of waste production, collection, storage, transport, treatment etc. of waste are the mayors of the municipalities or other persons authorized, the regional inspectorates of environment and waters, the Ministry, the inspectorate of Hygiene and epidemiology, and lastly the customs and border control authorities. Sanctions against offences are comprised in Chapter six. Offenders are liable to administrative measures and a penalty. The Additional provisions defines terms used in this Act and provides transitional and final provisions.
