Environmental Protection Act (R.S.P.E.I. 1988, c. E-9).

This Act concerns the management, protection and enhancement of the environment in the territory of Prince Edward Island. For the purpose of administering the Act, an Environmental Advisory Council may be appointed and its composition and operation are prescribed in section 4. Moreover, the Lieutenant Governor in Council may establish an Environmental Coordinating Committee (sect. 5). Section 7 covers the implementation and enforcement of the Act and section 8 concerns the analysis of samples to verify the quality of the environment. Section 9 is dedicated to environmental impact assessment and all related procedures. Section 10 concerns watercourses and their protection from pollution. Section 11 provides for the establishment of buffer zones to protect water courses from pollution originating from intensive livestock operations and to protect forested riparian zones.
Other provisions concern wells (sect. 12) and bulk water removal (sect. 12.1). Sections 13 to 19 are dedicated to waste treatment and water supply systems, their operation and related approvals and permits. Section 20 provides for discharge of contaminants and related remedial measures. Section 22 concerns the protection of sand dunes and beaches. Final provisions concern regulation, the powers and responsibilities of environmental officers and offences and penalties.
