Abstract
This Law, consisting in its consolidated version of 24 articles, provides for: harmonising Cyprus Legislation with the provisions of Regulation (EC) of the European Parliament and of the Council no. 1107/2009 concerning the placing on the market of plant protection products; defining authorisation procedure for plant protection products; marketing and making available to the user plant protection products; limiting the use of plant protection products; making official controls on the production and use of plant protection products; imposing sanctions. This Law concerns: establishment of the Plant Protection Products and Biocides Council as the competent authority; appointment of its members; delegation of Council powers; responsibilities of the Department of Agriculture on receipt and evaluation of applications and submission of data, on ensuring compliance with the provisions of this Law and the related Regulations, on coordinating cooperation with the European Commission, the European Food Safety Authority, the other Member States, applicants, producers and farmers on matters of plant protection products.
Concerning prohibitory provisions, this Law prohibits anyone from importing, trading, possessing, placing on the market, advertising or using within the country any plant protection product in violation of the provisions of the EU Regulation; it is also prohibited to place on the market a plant protection product with a label that contains conditions in violation of the terms of its authorisation, or in violation of the instructions written on its label; it is forbidden to use a plant protection product on crops other than those mentioned on the label of this product; the Law also prevents anyone from falsifying, destroying or detaching the whole or part of any label of a plant protection product, and from repacking a plant protection product. Further matters covered by this Law include: appointment and powers of inspectors, including: open and examine packages, enter and inspect any premises used for plant protection products manufacturing, take samples of plants or plant products; imposition of administrative sanctions and fines; offences and penalties; Ministerial power to issue Regulations.
