Abstract
An Act to provide for matters of food safety in relation to all food products, whether produced in Malta, imported into Malta or exported therefrom.
The Act consists of 52 sections which are divided into 6 Parts: Preliminary (I); Food Safety Commission (II); Regulations (III); General provisions (IV); Legal proceedings (V); Miscellaneous (VI).
“Food” is defined in section 2. Section 3 defines the application sphere of the Act. Section 4 contains a presumption regarding food intended for human consumption. The Food Safety Commission, established under section 5 shall monitor, co-ordinate and keep under review all practices, operations and activities relating to food and carry out for those purposes the functions listed in section 7. Power of the Commission to publish warnings or information regarding food safety is outlined in section 9. Part III defines regulation making powers of the Minister responsible for public health. Part IV contains provisions that regulate various matters such as registration of food premises, restrictions on placing on the market of food products, labelling of food, information and documentation to be supplied by persons carrying out a food business on request of the health authority as defined in section 2, restrictions on the importation of foods, food control and other inspections, improvement notices, prohibition orders, emergency control orders and other measures of enforcement.
