Abstract
This Decree-Law rules on the production, control and certification of agriculture and horticulture plant seeds for commercialization purposes. It transforms into national law the Council Directives No. 98/95/CE and No. 98/96/CE of 14 December 1998 and 2001/64/CE of 31 August 2001. It is composed of 34 articles and one Annex regulating field inspections and samplings to be undertaken by private agents under the authorization of the General Direction for Crop Protection. The Decree-Law stipulates that the Ministry of Agriculture, Rural Development and Fisheries will define by Order the implementing rules.

Council Directive 98/95/EC amending, in respect of the consolidation of the internal market, genetically modified plant varieties and plant genetic resources, Directives 66/400/EEC, 66/401/EEC, 66/402/EEC, 66/403/EEC, 69/208/EEC, 70/457/EEC and 70/458/EEC on the marketing of beet seed, fodder plant seed, cereal seed, seed potatoes, seed of oil and fibre plants and vegetable seed and on the common catalogue of varieties of agricultural plant species.

Decree-Law No. 318-91 regulating the production, control and certification of seeds of agricultural and horticultural species intended for marketing.
Repealed by
Decree-Law No. 144/2005 regulating production, control and certification of seeds of agricultural and horticultural species intended for marketing, with the exception of those used for ornamental purposes.
