Abstract
This Regulation establishes maximum limits for certain contaminants in food and outlines the responsibilities of food operators in identifying, preventing, reducing, or eliminating risks associated with contaminants. The provisions of this Regulation shall apply to mycotoxins, plant toxins, metals and other elements, halogenated persistent organic pollutants, processing contaminants and other contaminants that may be found in food. The food listed in Annex I shall not be placed on the market and shall not be used as a raw material in food or as an ingredient in food where it contains a contaminant at a level which exceeds the maximum level set out in Annex I.
This Regulation lays down provisions on the application of maximum levels of contaminants and placing on the market; maximum levels for dried, diluted, processed and compound food; prohibition on detoxification of food containing contaminants listed in Annex I; food to be subjected to sorting or other physical treatment before placing on the market for the final consumer or use as a food ingredient; labelling rules for groundnuts (peanuts), other oilseeds, derived products thereof and cereals; the responsibilities of food operators; and monitoring of the presence of contaminants in food and the progress with regard to the application of prevention measures to avoid contamination.
Food operators are required to comply with the regulation by December 31, 2023, unless specified otherwise. Products placed on the market before this date can remain until December 31, 2024, subject to certain conditions. This Regulation also covers sampling and analysis methods for contaminants with established maximum levels, ensuring compliance with existing legislation. It aligns with EU legislation, specifically Commission Regulation (EU) 2023/915, to ensure compliance with European Union standards.
