Abstract
The Regulations implement provisions of the Fisheries Act, 2003 and make further provision with respect to marine, inland fisheries and aquaculture, the development of fisheries, the conservation of fish resources and the processing of fish in Tanzania. The Regulations make in particular provision with respect to - registration of fishing vessels, fishermen and fish dealers; development and sustainability of resources and stock restoration; use of fishing gear; control of aquaculture; standards for fish and fish products. They also provide with respect to use of water and prohibit the pollution of water resources.
The Director of Fisheries shall a Registrar of fishing vessels. Every licensing officer shall keep and maintain a register of all fishing vessels in his or her area of jurisdiction in the form as set out in these Regulations. The Director may attach conditions to any licence issued under these Regulations.
As for the development of the fishery industry, every investor shall abide by the guidelines issued by the Director. Import of any live fish or aquatic flora, export of protected species and introduction of alien species require an authorization of the Director. No aquaculture practice shall be conducted in such a manner as to disrupt the integrity of the environment. Every large-scale aqua farmer shall be required to submit quarterly progress report to the Director. All aqua farmers shall ensure that: a) effluents from aqua farm do not cause pollution on other water bodies or aquatic ecosystem except in circumstances where the farmer cannot have control; and (b) no cultured species shall enter into trans-boundary aquatic ecosystem. Other specific requirements are set for large-scale aqua farms and seaweed farming.
The Director shall establish and maintain a Vessel Monitoring System (VMS) in the industrial sea fishery. Every commercial fishing vessel conducting fishing in sea waters shall be fitted with a VMS system and shall, while at sea, at all times have its VMS system turned on. A designated Monitoring Control and Surveillance (MCS) operations room shall coordinate all the functions of the VMS.
The Director shall ensure that the management of the approved establishments implement the Quality Management Programs based on standard procedures prescribed in respective GMP, GHP and HACCP manuals.
