Decree No. 53/2012/ND-CP amending and supplementing a number of articles of the Decrees on fisheries.

This Decree amends various articles of a number of Decree on Fisheries.
The Decree amends Decree No. 59/2005/ND-CP by substituting clauses 1-4 of article 6 and article 7 with new provisions on licensing procedures and order and on licensing agencies.
The Decree further amends Government’s Decree No. 33/2010/ND-CP by modifying the definitions in clause 4 and 5 of article 2; substituting point a, clause 1 article 4 on the determination of coastal areas; modifying article 6 with new provisions on conditions for fishing outside sea areas of Viet Nam; modifying article 7 on procedures and order to licence a vessel to fish in foreign sea areas; inserting new clauses 6 and 7 to article 9 on responsibilities of organizations and individuals engaged in fishing activities outside sea areas of Viet Nam; and by replacing Appendix I with a new Appendix (not available in this Gazette).
It also amends Decree No. 32/2010/ND-CP by making minor changes to clause 2, article 3 on the definition of Viet Nam’s sea areas; modifying clause 3 and inserting clause 5 to article 4 on principles of fishery activities of foreign fishing vessels in Viet Nam’s sea areas; modifying articles 5, 8, 10 and 11 on fishery operation permits of foreign fishing vessels; modifying clause 9 of article 13 on responsibilities of owners of foreign fishing vessels; and by replacing Appendix I and II with new Appendixes (not available in this Gazette).
The Decree, in addition, amends Decree No. 52/2010/ND-CP by modifying article 4 on conditions that imported fishing vessels must meet; repealing articles 5 and 6; modifying article 7 on order and procedures for importing fishing vessels; modifying clause 4 of article 12 and article 13 on the registration of imported fishing vessels; and modifying articles 15 and 16 on the competence to decide on the import of fishing vessels and to register the imported vessels.
