Abstract
This Decree provides detailed regulations of a number of articles of the Fisheries Law and measures to implement the Fisheries Law. The Decree consists of 75 Articles divided into 8 Chapters: General Provisions; Protection and Development of Fisheries Resources; Aquaculture; Capture Fisheries; Management of Fishing Vessels, on-Duty Vessels, Fishing Ports and Shelters of Fishing Vessels; Fisheries Surveillance; State Management of Fisheries; Executive Provisions. Annex IV is on the Template for Capture Fisheries and Annex V is on Templates of Management of Fishing Vessels, on Duty Vessels, Fishing Ports, Shelter for Fishing Vessel.
Regarding management of rare, specious and endangered aquatic species, the Decree provides for the list and criteria for identifying rare, specious and endangered aquatic species. Endangered, precious and rare aquatic species are classified into two groups, including Group I and Group II. Group I shall only be exploited for one of the following purposes: Conservation, scientific research, research for development of original breed sources and international cooperation. Group II shall only be exploited for one of the following purposes: Conservation, scientific research, research for development of original breed sources and international cooperation or meet the requirements specified in Part II, Annex II of this Decree. Organizations and individuals that exploit endangered, precious and rare aquatic species for the purpose of conservation, scientific research, research for development of original breed sources and international cooperation shall be approved by the Directorate of Fisheries by a written approval and report to the Directorate of Fisheries on the results of implementation.
The Decree further make provisions, inter alia, for: functions, duties of aquatic resources protection and development fund; conditions for establishments of aquatic seedlings producers; issuance, re-issuance and withdrawal of certificates of establishments eligible for aquatic seedlings production and nursing; inspection to maintain basic conditions for establishments; import and export of aquatic seedlings; conditions for feed production establishments and aquaculture environmental treatment products; issuance, re-issuance and withdrawal of certificates of eligibility for aquatic feed production, aquaculture environment treatment products; issuance and revocation of certificates of establishments eligible for aquaculture production at the request of organizations and individuals; registration of aquaculture of cages, key aquatic seedling animals; licensing of aquaculture on the sea for foreign investors and foreign-invested economic organizations; fishing zones; management of fishing vessels in Vietnam’s waters; managing fishing vessel monitoring system; granting, renew and withdraw fishing license; issuing the written approval for fishing vessels operating outside Vietnam's sea areas or granting permits for fishing in waters under management jurisdiction of Regional Fisheries Organizations; foreign fishing vessels entering the fishing port; etc.
