Law No.116-IQ on land amelioration and irrigation.

The present Law establishes legal basis of activity in the sphere of drainage and irrigation. The Law consists of 7 Sections composed of 32 articles. Section 1 (arts. 1-4) lays down general provisions. Section 2 (arts. 5-8) regards the right of ownership of drainage and irrigation systems. Section 3 (arts. 9-11) establishes plenary powers of executive bodies and municipalities in the sphere of drainage and irrigation. Section 4 (arts. 12-18) regards state management in the sphere of drainage and irrigation. Section 5 (arts. 19-27) establishes the modalities of carrying out drainage and irrigation arrangements. Section 6 (arts. 28-30) regards financing of drainage and irrigation arrangements. Section 7 (arts. 31-32) regards dispute settlement and establishes liability for the infringement of the legislation in the sphere of drainage and irrigation.
Water Users Union is defined as a private non-profit organization established and operated by agricultural producers in accordance with this Law to manage irrigation systems and provide irrigation water to crops in the field of service. The purpose, duties, powers, structure and inspection of the Union are determined in Section 6-1. The Union shall be inspected by the competent authority which is responsible for amelioriation and irrigation. Moreover, the powers of the competent authority is listed in Article 13 and the rules for certification, registration, restoration and reconstruction of amelioration and irrigation systems are laid down in Article 14.
In addition to the amendments regarding the Water Users Union, this Law also includes amendments on the planning and implementation of amelioration and irrigation measures and regulation of water relations during the improvement and use of irrigation systems.
