Abstract
These Measures are developed in accordance with the Food Safety Law of the People's Republic of China, the Administrative Licensing Law of the People's Republic of China, for purposes of regulating the licensing for the production of food and food additives, strengthening the supervision and administration of food production, and ensuring food safety. The Text consists of 8 Chapters: General Provisions (I); Application and Acceptance (II); Examination and Decision (III); License Management (IV); Change, Reissuance and Cancellation (V); Supervision and Inspection (VI); Legal Liabilities (VII); Supplementary Provisions (VIII).
A food production license shall be obtained in accordance with the law to engage in food production activities in P.R. China (art.2). The principle of one license for one enterprise shall apply to the licensing for food production (art.4). Competent market supervision and management authorities shall implement categorized licensing for food production on the basis of the degree of food risks (art.5). Local competent market supervision and management authorities at and above the county level shall take charge of food production licensing within their respective administrative regions (art.6). Competent market supervision and management authorities of provinces, autonomous regions and municipalities directly under the Central Government shall take charge of the licensing for the production of health food, formula food for special medical use, infant formula food, supplementary foods for infants and young children, and table salt (art.7). The Measures provide further for the procedures, conditions and requirements for food production licensing, and the measures for supervision and inspection, offences and penalties.
