Abstract
The Act on Fertilizers and Soil Improvers regulates the production, sale, labeling, and use of fertilizers, soil improvers, composts, growth media, and related products in Denmark. The law ensures these products are safe for humans, animals, plants, and the environment, and conform to quality standards. It also aligns national rules with EU regulations on plant nutrition and soil management products. The Minister for Food, Agriculture and Fisheries is empowered to issue rules on product content, registration, traceability, and market surveillance, including for products not originally covered but with similar effects.
Administratively, the act authorizes inspections, enforcement actions, and online content takedowns if products are found non-compliant. It includes detailed provisions for digital communication, information sharing, and public disclosure of inspection results. Violations can result in fines, and enforcement includes access to private property without a court order. Appeals generally go to the Environmental and Food Appeals Board. The law ensures Denmark complies with EU directives and includes mechanisms for adapting oversight and enforcement in light of technological and regulatory developments. It does not apply to Greenland and the Faroe Islands unless specifically extended.
