Abstract
This Decree approves the General Regulation on Marine Fisheries (REPMAR). The Regulation regulates Law No. 22/2013 on the Fisheries Law approved on 1 November 2013, with regard to marine fishing. This Regulation aims to regulate Fisheries Law No. 22/2013 of 1 November, on maritime fishing activity. This Regulation applies to: a) national or foreign people fishing in the maritime waters of Mozambique; b) fishing in the maritime waters of Mozambique, with Mozambican or foreign fishing vessels; c) fishing activities and related fishing operations carried out in the maritime waters of Mozambique; d) foreign fishing vessels, which sail in or towards Mozambican maritime waters; e) fishing carried out with Mozambican fishing vessels, in the maritime waters of third States; f) fishing carried out on the high seas by Mozambican fishing vessels. The application of this Regulation extends to complementary fishing activities, namely, ship-building and repair, fish processing, fish marketing, port services, manufacture of fishing gear and other accessories intended for fishing activities and fishing related operations.
The exercise of fishing activity requires related fishing rights and the respective fishing licence. Fishing rights for foreign fishing operators are granted through fishing agreements and contracts concluded under the Fisheries Law. The granting of fishing rights and the procedures for licensing fishing activities are defined by a specific regulation approved by the Government. The Central Fisheries Administration Body is responsible to establish licensing terms and conditions of foreign fishing vessels operating in Mozambique's jurisdictional waters, in accordance with national legislation, conservation and management of the Regional Fisheries Management Organizations (RFMO) and the regional and international instruments for the management and control of fishing activities. The Decree is composed of 171 articles divided into nine Chapters and 15 Annexes, aiming to regulate the following sectors: General provisions (Chap. I); Fisheries planning and management (Chap. II); Fishing methods and gear (Chap. III); Fishing vessels (Chap. IV); Monitoring of fishing activity (Chap. V); Conservation and protection of fishery resources (Chap. VI); Maritime safety and fisheries surveillance (Chap. VII); Fees (Chap. VIII); Temporary provisions (Chap. IX).
