Abstract
This Law is enacted in accordance with the Constitution for the purposes of guaranteeing effective grain supply, ensuring national grain security, improving the ability to prevent and resist grain security risks, and maintaining economic and social stability and national security.
The Law consists of 74 Articles divided into 11 Chapters: Chapter I General Provisions; Chapter II Protection of Cultivated Land; Chapter III Grain Production; Chapter IV Grain Reserve; Chapter V Grain Circulation; Chapter VI Grain Processing; Chapter VII Grain Emergency; Chapter VIII Grain Conservation; Chapter IX Supervision and Administration; Chapter X Legal Liability; Chapter XI Supplementary Provisions.
To ensure that the quantity and quality of cultivated land are guaranteed and improved, the Law stipulates to implement land use control and establish red lines for the protection of cultivated land and permanent basic farmland; establish a compensation system for farmland protection and for occupying arable land; establish a strict system for protecting the quality of cultivated land, strengthen the construction of high standard farmland, conduct investigations and evaluation monitoring of cultivated land quality, and improve the quality of cultivated land.
In terms of improving the mechanism of the grain reserve system, the state shall establish a grain reserve system, reasonably determine the variety structure and regional layout of grain reserves, and ensure the safety of quantity and quality. The entities that store government grain shall establish and improve internal management and risk reporting systems.
In order to enhance disaster prevention, reduction, and emergency response capabilities, the state shall, 1) establish and improve a monitoring and early warning system for agricultural natural disasters and biological disasters, and strengthen research and application of prevention and control technologies; 2) improve the policy based agricultural insurance system and encourage the development of commercial insurance business; 3) establish a grain emergency management system with unified leadership, hierarchical responsibility, and territorial management.
In addition, the state shall guide social capital to invest in grain production, storage, circulation, processing and other fields, support agricultural business entities such as family farms and farmers' professional cooperatives to engage in grain production, and strengthen international grain security cooperation and give full play to the role of international grain trade.
