Decree No. 48 of 2004 (IV. 21.) of the Ministry of Agriculture and Rural Development concerning the production and marketing of seeds of agricultural crop species.

This Decree applies to: seeds and planting materials of agricultural crops (cereals, beets, fodder plants, oil and fibre plants, potato); to their production, processing, marketing, utilization and packaging; to the activities of classification, control and monitoring. It consists of seven chapters. Chapter 1 determines general provisions and determines terms used. The control on the production and marketing of seeds is the duty of the Hungarian National Food-chain Safety Office and of the Plant and Soil Protection Directorates of the County Governmental Offices. Chapter 2 rules the marketing of seeds. Seeds must meet the requirements determined in annexes 1-5. Exceptions are rules in articles 5-10. Chapter 3 contains rules on the production of seeds. This chapter lays down provisions regarding the certification of origin of seeds and reproduction of seeds, classification and controlling activities, zoning and protective buffer zones, Chapter 4 sets forth provisions on sealing, sampling, labeling, imported seeds. Chapter 5 rules seed processing and packaging. Chapter 5A contains special provisions regarding seeds contaminated by GMO. It is forbidden the marketing and cultivation of GMO seeds in the territory of Hungary. Chapter 6 lays down provisions regarding the control of the enforcement of this Decree and sanctions for offenders Chapter 7 contains final provisions.
