Abstract
This Act regulates the conservation and maintenance of genetic materials, the recognition of plant varieties, the use of breeds, rights and obligations of actors in this sector, for the purpose of conservation and development of biological resources of plant production. Conformity to the characteristics of registered plant varieties must be maintained by the breeder or its delegate and it must be controlled by the competent authority. The Act provides rules regarding production and marketing of planting materials. Planting materials must be qualified according the rules of a separate legal norm. The Act regulates packaging and labeling of planting materials as well. Some rules of the Act deals with the duties of the competent authority. The Act contains also rules on sanctions and penalties for offenders.
