Abstract
This Law regulates the system for protection and rescue of people, environment, material goods, natural resources, animals, flora and cultural heritage from natural disasters and others accidents in peace, state of emergency and/or during martial law in the Republic of North Macedonia.
The Law is divided into the following thematic Chapters: I. Basic provisions; II. Protection and rescue planning; III. Competences of the bodies of state government; IV. Competences of the units of local self-government; V. Liabilities of commercial companies, public enterprises, institutions and services; VI. Rights and duties of citizens in protection and rescue; VII. Citizens 'associations, humanitarian and non-governmental organizations; VIII. Protection and rescue measures; IX. Protection and rescue forces; IX-a. Salary, salary supplements and other employment rights, material and disciplinary responsibility of flight staff, aircraft technical and other professional staff and employees directorate that do not have status of civil servants; X. Awarding recognitions; XI. Self-defense; XII. Monitoring and notification; XIII. Protection and rescue training; XIV. Financing of protection and rescue; XV. Fees for execution of rights and duties in protection and rescue; XVI. Supervision; XVII. The protection and rescue in the Republic is organized as a single system to detect and prevent the occurrence and elimination of consequences from natural disasters and other accidents and providing necessary assistance. Protection and rescue is a related planning process, programming, organizing, managing, commanding, coordinating, implementation, financing and supervision for timely and effective prevention as and preparing, acting on, and eliminating the causes and consequences of natural disasters and other accidents. Protection and rescue is a matter of public interest, and it shall be organized and implemented by state bodies, bodies of state administration, bodies of units of local self-government, public enterprises, public institutions and services, companies, citizens' associations, citizens and protection forces and rescue, in a manner regulated by this Law, among regulations adopted on the basis of the same, as well as the norms, standards and rules of technical practice. The goals of this Law shall be achieved through: observing, detecting, monitoring and studying the possible dangers of natural disasters and other accidents; taking preventive measures to mitigate and prevent occurrence of possible dangers; informing and warning about possible dangers and giving instructions for protection, rescue and assistance through a single notification system; training, coaching and exercises for training for protection, rescue and assistance; organizing the protection and rescue forces and establishing and maintaining other forms of preparedness for protection, rescue and assistance; self-protection, self-help and mutual assistance; mobilization and activation of the forces and means for protection and rescue; determination and implementation of protection measures; rescue and assistance; elimination of the consequences of natural disasters and other accidents, up to providing basic living conditions; supervision of the implementation of protection and rescue; providing assistance to areas that have suffered damage on a larger scale than natural disasters and other accidents; providing assistance to other countries that have suffered damage on a larger scale than natural disasters and other accidents, which have expressed the need for it; receiving assistance from other countries; identification and assessment of hazards; keeping a database of all sources of risks and dangers from natural disasters and other accidents; preparation of an assessment of the threat from natural disasters and other accidents and protection and rescue plans and updating them. The protection and rescue in the Republic is based on the following basic principles specific principles: 1) everyone has the right to protection and rescue from natural disasters and others accidents; 2) in the protection and rescue from natural disasters and other accidents give priority to human life and health; 3) in the event of natural disasters and other accidents, everyone is obliged to assists within its capabilities; 4) The Republic, the municipalities and the city of Skopje, public enterprises, institutions and services and companies are obliged to organize them in a timely manner and take preventive and operative measures for protection and rescue from natural disasters and other accidents; 5) every natural and legal person, in accordance with the law, is responsible for non-implementation of the envisaged protection and rescue measures; 6) the model is used when engaging the protection and rescue forces of gradualness, with the owner's forces reacting first, then the municipalities and the city of Skopje, the Republic and the international community; 7) the data on the dangers and the undertaken protection activities and rescue, by the competent authorities and services are public and must be published transparently.
