Abstract
This Act concerns the prevention of the importation into Seychelles of pests and diseases affecting animals and plants and more in general biosecurity, i.e. a strategic and integrated approach that encompasses the policy and regulatory framework for analysing and managing relevant risks to animal and plant life and the associated risks to the environment, economy and public health. The Act makes provision for the control of “regulated articles” i.e. which includes, but is not limited to: (a) any animal or animal product; (b) any plant or plant product; (c) any living organism, whether modified or not; (d) soil and garbage; (e) a regulated pest or disease; (f) any invasive alien species. Regulated pest or disease" means a pest or disease, the importation into Seychelles of which is prohibited or restricted by the Regulations.
The Act provides for inspection, quarantine, treatment and other pest and disease control measures regarding regulated articles. The President may designate a statutory or governmental body, authority or agency to be the agency responsible for biosecurity. Functions and powers of the agency are defined. The Agency may enter into a written compliance agreement with any person including an importer, exporter or producer. The Agency shall have regard to the international obligations of Seychelles in respect of biosecurity and may apply the precautionary principle. The Minister may also facilitate the conclusion of cooperation bilateral or multilateral agreements between the Seychelles and other countries and international organisations for effective international control in biosecurity matters.
The Act establishes a National Biosecurity Committee, which shall advise and provide guidance to the Agency and the Director of Biosecurity on policy and technical matters. The Act furthermore provides for, among other things: biosecurity port quarantine measures and other biosecurity import measures; internal quarantine and control measures; biosecurity emergencies; and biosecurity export procedures.
