Abstract
This Law provides for the prevention and control of environmental pollution by solid wastes, the safeguard of human health, ecological safety and the sustainable development of economy. This Law shall not be applicable to the prevention and control of marine environmental pollution by solid wastes or of environmental pollution by radioactive solid wastes.
The prevention and control of solid waste pollution adheres to the principles of reduction, resource utilization and harmlessness (art.4). The State promotes green development mode and promotes clean production and circular economy. The State advocates a simple, moderate, green and low-carbon lifestyle and guides the public to actively participate in the prevention and control of solid waste pollution (art.3). Technical standards on the prevention and control of environmental pollution by solid wastes shall be formulated. It is prohibited to import solid waste from outside the People's Republic of China for dumping, stacking, and disposal (art. 23). The entities discharging industrial solid wastes shall truthfully record the types, quantities, flow, storage, utilization, disposal and other information of industrial solid waste generated, make industrial solid waste traceable and searchable, and take measures to prevent and control environmental pollution by industrial solid waste. (arts. 36). The people's governments at or above the county level shall plan to build facilities for collecting, transporting and treating urban-rural consumer wastes, improve the ratio of utilization and harmless treatment of consumer wastes, promote industrial development of collecting and treating consumer wastes, and progressively establish a social service system for preventing and controlling environmental pollution by consumer wastes (Chapter III). The Law further makes provisions, inter alia, for: the prevention and control of environmental pollution by hazardous wastes, domestic wastes, construction wastes, agricultural solid wastes, etc.; offences an penalties.
