Abstract
This Regulation is developed for the purposes of strengthening the administration of pesticides, ensuring the quality of pesticides, guaranteeing the quality safety of agricultural products as well as the safety of people and livestock, and protecting agriculture and forestry production and ecological environment.
The Regulation consists of 66 Articles in eight Chapters. The pesticide is defined in article two. A registration system shall be adopted. Pesticides produced in China and exported to China need to apply for registration. If they meet the conditions after registration test and registration review, the Ministry of Agriculture shall issue a pesticide registration certificate and make an announcement. The Ministry of Agriculture shall organize and establish a pesticide registration and review committee to be responsible for pesticide registration and review. When applying for pesticide registration, the registration test shall be carried out first, the registration test shall be reported to the local provincial agricultural department for the record, and the registration test of new pesticides shall be approved by the Ministry of agriculture. The registration test shall be conducted by the registration testing institutions recognized by the Ministry of Agriculture, and the registration test institutions shall be responsible for the authenticity of the registration test report. A license must be obtained for manufacturing pesticides. Chapter four and five concern the marketing (including labeling) and use of pesticides. According to Article 35, pesticide users shall protect the environment, protect beneficial organisms and rare species, and shall not discard pesticides, pesticide packages or clean pesticide application instruments in drinking water source protection areas and river courses. It is strictly prohibited to use pesticides in drinking water source protection areas, and it is strictly prohibited to use pesticides to poison fish, shrimp, birds, animals, etc. Chapter six prohibits the manufacture and sale of adulterate pesticides.
