Environment and Gene Technology Act (No. 9 of 2017).

This Act helps promulgate safeguard of the environment and applies to the production and use of genetically modified organisms in plants, animals, micro-organisms, cell cultures and virus. The Act also applies to territorial waters and the fishing territory, to the processing, storage, bottling, packaging, repackaging and to waste management. Genetically modified organisms may only be manufactured, used, imported, transported, exposed, sold or marketed following laboratory research and approval by the Danish Ministry of Environment and Food. Medical substances or preparations produced for human consumption consisting of or containing manufactured genetically modified organisms do not require approval if their release is approved under other EU legislation meeting the requirements for approval under Directive 2001/18 / EC of 12 March 2001, article 5. The validity of the first approval for marketing may not exceed 10 years. Other approvals (part or whole of authorization) may be time-limited (art. 16.2). Approval may change the terms of licenses and issue an Order if it is justified on grounds of environment, nature or health, cleaner technologies, production methods or improved treatment forms have been developed (art. 17).
