Abstract
This Act provides rules for the protection of the health and welfare of animals. The Act provides rules for animals in general and specifically those held by humans to implement European obligations and in the interest of health and well -being of animals and of public health, to recognize the intrinsic value of the animal and considers the ethical aspects of biotechnology. Rules concerns, among other things, animal feeds, veterinary medicinal products and veterinary medicine, breeding of races, the sale of animal products, and the protection of the environment in relation to keeping and treatment of animals. The Act is divided into 12 Chapters: General (1); Animals (2); Animal products (3); Admission of professions in the exercise of veterinary medicine (4); Implementation Measures (5); Carrying into effect of EU Measures (6); Permits, recognitions, permissions, authorizations, registrations, reports and registers (7); Enforcement (8); Financial matters (9); Miscellaneous (10); Amendments and transitional (11); Final provisions (12). The Act in general applies to animals kept in captivity but the parts about animal products also apply to products derived from wild animals. The Act generally delegates powers to the Minister to further regulate matters covered by this Act by General Administrative Measure (AMVB), also for the carrying into effect or implementation of EU instruments.
The Act recognizes in Article 1.3 the intrinsic value of animals as living beings. Chapter 2 provides rules for the treatment and keeping of animals. It, among other things specifies various prohibitions and lays down rules for the keeping, identification, transportation, breeding, veterinary treatment of animals and trade in animals. the Chapter also touches upon certain aspects concerning the control of health of animals and certain aspects of animal feed, veterinary medicines and biotechnology.
The third Chapter is about animal products including meat and animal by-products. It is mainly about delegation of regulation-making powers of the Minister and implementation of EU rules. Chapter 4 is about veterinary professions. Chapter 6 contains technical rules about implementation and carrying into effect of EU instruments. Chapter 7 applies to decisions taken under this Act. It may be stipulated in the rules laid down under this Act that a report or a decision to grant a permit, recognition, permission, registration, proof of professional competence, approval, exemption, exemption, exemption, generally binding statement or certification can be granted or can be provided. The Minister shall be assisted in this or her work on the implementation and carrying into effect of provisions of this Act by an Advisory Commission.
